  3. Are your conversations used to train the underlying model?

Regulatory track record

2025–2026 brought real enforcement to this category:

  • Replika (Luka Inc): a €5M GDPR fine from Italy’s Garante in 2025 — for lacking a valid legal basis for processing user data and for inadequate age verification — plus a January 2025 FTC complaint filed by advocacy groups (the Young People’s Alliance, Encode and the Tech Justice Law Project) over deceptive marketing and design. The FTC itself has not announced an enforcement action. New US state laws followed in 2026.
  • Character.AI: after child-safety lawsuits — including a Florida case over a 14-year-old’s death and a Texas suit brought by two families — it removed open-ended chat for under-18 users effective November 25, 2025 and added age-assurance checks.

Emotional safety

A companion app can offer company and low-pressure conversation. It is not a replacement for human relationships or professional mental-health care. Be mindful of over-reliance, and choose apps with clear adult-only gating and honest content policies.

So, are they safe?

Broadly yes — with the right app and the right habits. Pick an app with strong, stated data practices, run the four checks above, and keep expectations realistic about what a companion is.

Safety by use case

Different users need different safety checks.

Everyday friendship. Prioritize SFW boundaries, clear deletion, low-pressure conversation and no aggressive romance upsell. Pi, Nomi and Replika sit closer to this use case than image-first adult apps, though Replika still carries the strongest regulatory history.

Long-term romantic companion. Memory matters more here because the app encourages continuity. That also makes privacy matter more, because the app may collect a fuller emotional profile over time. Nomi and Kindroid are the strongest starting points in our current scoring because memory and control are clearer.

Adult roleplay. Check adult-content gating, payment descriptors, media retention and whether generated images are stored or shareable. Adult content is not automatically unsafe, but it raises the cost of a privacy mistake.

Warning signs during use

Stop or step back if an app repeatedly:

  • Encourages isolation from real people
  • Claims to be therapy or a replacement for professional care

  • Refuses to explain deletion, export or training practices
  • Makes it hard to cancel after an easy sign-up

A safer setup routine

Start with a limited account and a low-sensitivity test. Do not upload photos, voice clips or deeply identifying personal details in the first week. Read the privacy policy, run the privacy checklist, and check the true monthly cost before subscribing.
